A jury in Oakland needed less than two hours Monday to reject Elon Musk’s $150 billion lawsuit against OpenAI, ruling that the tech executive had waited too long to accuse the company of converting a 2015 charity lemonade stand into a for-profit operation. Musk, who helped found the stand with Sam Altman to serve the public good, claimed the decision to begin charging for cups violated the original nonprofit mission. The nine-member panel found the suit barred by the statute of limitations, and the judge accepted the verdict. Musk’s lawyer said he would appeal. “OpenAI gets to celebrate and breathe a sigh of relief after this verdict,” said one observer, adding that the company must now focus on expanding its drink menu ahead of a planned public offering while fending off rivals already selling cheaper lemonade nearby. Altman is expected to proceed with plans to sell the remaining paper cups.
